A Federal High Court in Lagos has directed the National Drug Law Enforcement Agency (NDLEA) to produce socialite Afolabi Kazeem Micheal, popularly known as KayCee Luxury, before the court over his continued detention without formal arraignment.
The order followed an ex parte application filed by Afolabi through his lawyer, A. Labi-Lawal, SAN, under the Fundamental Rights (Enforcement Procedure) Rules, 2009.
NDLEA operatives arrested Afolabi on August 13 at the Murtala Muhammed International Airport in Lagos while he was preparing to travel to Paris.
Following his arrest, his legal team approached the court after he had spent more than 14 days in custody without, according to the application, being formally charged or arraigned.
Afolabi is asking the court to intervene, arguing that his continued detention amounts to a violation of his fundamental rights.
After considering the application, the court ordered the NDLEA to bring Afolabi before it so the matter can be heard.
The directive means the agency is expected to present the socialite before the court as proceedings continue over the circumstances surrounding his detention.
